mySM3 is a social media marketing management platform operated by Carsten Neufing ("operator"). It enables clients to plan, create, publish, and optimize marketing content and advertising campaigns on social media platforms they connect via OAuth.
Clients connect only accounts they own or are authorized to manage. All content publications and campaign changes are made on the client's behalf and with the client's authorization. Clients are responsible for keeping their credentials confidential.
Clients are responsible for the content they approve and publish through mySM3, including its compliance with applicable law and the policies of the target platforms (Meta, Google/YouTube, TikTok). Advertising spend is billed by the respective platform directly to the client's own advertising account.
The service may not be used for unlawful, misleading, or deceptive content, spam, or content violating third-party rights or platform policies. AI-generated media published through mySM3 is labeled according to the target platform's disclosure rules. The operator may suspend accounts that repeatedly violate these terms or platform policies.
The service is provided without warranty of uninterrupted availability. The operator is liable without limitation for intent and gross negligence; for slight negligence only in case of breach of essential contractual obligations and limited to the typical foreseeable damage.
These terms may be updated; material changes will be communicated to registered clients in advance. Governing law: Swiss law; place of jurisdiction is the operator's domicile.
mySM3 ist eine Plattform zur Verwaltung von Social-Media-Marketing. Klienten verbinden nur eigene bzw. von ihnen verwaltete Konten; für freigegebene Inhalte und deren Rechtmäßigkeit sind die Klienten verantwortlich. Werbebudgets rechnen die Plattformen direkt mit dem Klienten ab. Unzulässig sind rechtswidrige, irreführende oder richtlinienwidrige Inhalte; KI-generierte Medien werden plattformkonform gekennzeichnet. Haftung: unbeschränkt bei Vorsatz und grober Fahrlässigkeit, bei einfacher Fahrlässigkeit nur für Kardinalpflichten und begrenzt auf den vorhersehbaren typischen Schaden. Es gilt schweizerisches Recht; Gerichtsstand ist der Sitz des Betreibers.
